In seiner Rechtslehre formuliert Kant das allgemeine Rechtsgesetz als obersten Grundsatz des Rechts. Es dient als ein uberpositives Kriterium dafur, ob eine Handlung rechtmassig oder unrechtmassig ist. Nach dem allgemeinen Rechtsgesetz ist eine Handlung nur dann rechtmassig, wenn sie die allgemeine Handlungsfreiheit des Einzelnen in groesstmoeglichem Masse achtet. Auch vermeintlich banale Handlungen stehen zumindest prima facie unter rechtlichem Schutz. Die kantische Rechtskonzeption entspricht damit der umstrittenen verfassungsgerichtlichen Interpretation des Art. 2 Abs. 1 GG. Das Reiten im Walde oder das Taubenfuttern - zwei Falle aus der Rechtsprechung des Bundesverfassungsgerichts - sind mit anderen Worten auch bei Kant in rechtlicher Hinsicht geschutzt. Eine Handlung, bzw. eine Massnahme, die derart vermeintlich banale Handlungen verbietet, ist grundsatzlich rechtswidrig. Die Frage lautet: Warum ist das so? Das Bundesverfassungsgericht beantwortet diese Frage vorwiegend mit einem Verweis auf den historischen Willen des Parlamentarischen Rates. Das Werk gibt eine philosophisch fundierte Antwort auf die Frage, weshalb auch vermeintlich banale Handlungen rechtlich schutzenswert sind. Kalscheuer behandelt damit eines der Hauptprobleme des Verhaltnisses von Recht und Moral bei Kant.
