Das EU-Kartellrecht ruckt vor allem durch die immens hohen Bussgelder ins Blickfeld. Daher wird naher beleuchtet, inwieweit die Sicherungen der EMRK und des Strafrechts eingreifen und damit die Grundsatze ne bis in idem, nulla poena sine culpa und in dubio pro reo. Blosse Vermutungen koennen schwerlich ausreichen. Entgegen dem EuGH im Urteil Schenker ist auch ein Verbotsirrtum zuzulassen. Im materiellen Kartellrecht be-sonders brisant ist die Frage der Zurechnung des Verhaltens von Tochter- und Schwestergesellschaften sowie die Austarierung zwischen freiem unternehmeri-schen Verhalten und dem Angewiesensein anderer Unternehmen auf Zugang etwa zu Plattformen. Dafur stehen insbesondere die Microsoft-Urteile. Das Kartellver-fahren wurde durch den Konflikt zwischen Kronzeugenschutz und Akteneinsichts-recht uberschattet (Urteile Pfleiderer, Donau Chemie). In der Fusionskontrolle, die durch die vermehrten Firmenzusammenschlusse wieder starker ins Blickfeld ruckt, waren wichtige Zustandigkeitsfragen Gegenstand der Entscheidungspraxis (Fall Holcim). Diese und weitere Fragen werden praxisorientiert und mit wissenschaftlicher Grundlichkeit bearbeitet. Die Darstellung wuchs gegenuber der letzten Auflage um mehr als die Halfte.
