Studienarbeit aus dem Jahr 2014 im Fachbereich Jura - Rechtsphilosophie, Rechtssoziologie, Rechtsgeschichte, Note: 16, Bayerische Julius-Maximilians-Universitat Wurzburg, Sprache: Deutsch, Abstract: Unter Kindestoetung im weiten Sinne wird die vorsatzliche Toetung eines Kindes durch die Eltern, insbesondere durch die Mutter, verstanden und es handelt sich um einen Spezialfall des damaligen Verwandtenmordes. In einer engeren, speziellen Anwendung bezeichnet die Kindestoetung die vorsatzliche Toetung eines neugeborenen, ausserehelich gezeugten Kindes wahrend oder gleich nach der Geburt; Taterin kann nur die Mutter sein. Letztere Definition ist Gegenstand der vorliegenden Arbeit. Die Herausbildung der Kindestoetung, die als eigenstandiges Delikt in der Constitutio criminalis Bambergensis von 1507 den ersten Niederschlag erfuhr, ist im besonderen Masse durch gesellschaftliche und soziale Faktoren sowie durch religioese Ansichten und gangige Moralvorstellungen gepragt. Soziale Stellung unehelicher Frauen, wie auch das Umfeld der typischen Taterin, die Rolle der Frau in der Gesellschaft und die des Hausverbundes sind Teil der mit der Kindestoetung zusammenhangenden Krafte. Als typisches Frauendelikt, das in der fruhen Neuzeit am haufigsten die Todesstrafe nach sich zog, ist es bis heute, auch nach Abschaffung des 217 a.F. StGB am 1. April 1998 durch das 6. Strafreformgesetz, sehr medienwirksam. Hier gilt der makabere Satz, dass jeder Tote fur die Presse lebendig sei, in ganz besonderem Masse. Die Entwicklung von einem qualifizierten zu einem privilegierten Toetungsdelikt fand durch die Ersetzung der oftmals besonders grausam und ehrverletzend vollzogenen Todesstrafe durch die Androhung einer Freiheitsstrafe in den Partikulargesetzgebungen des 19. Jhd. ihre Vollendung, woran sich eine allgemeine Humanisierung des Strafrechts feststellen lasst. So muss auch die Wandlung der Strafverfahren, nicht nur in Hinblick auf das Instrumentarium der Wahrheitsfindung, sondern auch in Bezug au
