Die Arbeit untersucht Aktienbanksatzungen aus dem 19. Jahrhundert auf aufsichtsrechtliche Aspekte, unterteilt nach ihrem Grundungsdatum vor und nach 1870 und nach Banken mit und ohne Notenausgabeprivileg. Vor der Aktienrechtsnovelle von 1870 ermoeglichte sich der Staat ein unterschiedlich ausgestaltetes Oberaufsichts- und Mitspracherecht hinsichtlich Grundung und Geschaftstatigkeit der Banken mittels Konzessionserfordernis. Nach 1870 wich das Konzessions- einem Normativsystem mit obligatorischer Bildung eines Aufsichtsrates. Banken unterlagen der Gewerbe- und damit der Grundungsfreiheit. Kontrolle und Aufsicht sollten in Eigenregie stattfinden mit Befangenheitsgefahr der Akteure. Eine neutrale externe Aufsichtsinstanz fehlte.

The blue vinyl colour is darker than in the generic picture used (see my photo of actual vinyl colour). Nevertheless, it’s still a nice package with the very nice illustration booklet inside. Delivery time is a little stretched, but with free postage and a good value package, this has to be expected (delay was probably caused by the royal mail anyway). Communication was excellent and I’m glad I made my purchase from Rarewaves Outlet. Thumbs Up!
