Die Untersuchung der Gesetzgebung zeigt, dass die Weichen fruh gestellt werden. Das betrifft einerseits die Moeglichkeiten wissenschaftlicher Einflussnahme, andererseits entscheidet sich ebenso fruh, wie das Ergebnis des Gesetzgebungsprozesses aussehen wird. Vor diesem Hintergrund beschaftigt sich das Buch zunachst mit den Anlassen der Neuschaffung materiellen Strafrechts anhand dreier aktueller Beispiele: 52a WaffG, 89a StGB (sog. Terrorcamp-Vorschrift) und 238 StGB (Stalking). Der Autor stellt die Anlasse anschliessend den Ergebnissen der Gesetzgebung gegenuber und skizziert deren dogmatische Struktur. In einem Ausblick wird eine Kritik der Anlasse und Ergebnisse der Gesetzgebung anhand des gangigen Konzeptes des Rechtsgutes versucht.
