Giving the benefit of the doubt here. Described as new and item appeared to be new when it arrived but obviously was not new because it failed to work due to a jammed staple. On the plus side, seller was willing to accept the return even though the post said he did accept returns. I was able to clear the jam and the stapler worked perfectly afterwards. Therefore, I decided not to return the item.
