A chi si applica il diritto di recesso?

Il D.lgs. 206/05 (codice del consumo) prevede che il diritto di recesso sia esercitabile dalle sole persone fisiche (consumatori) che agiscono per scopi che possono considerarsi estranei alla propria attività commerciale. Il diritto di recesso, quindi, non può essere esercitato dalle persone giuridiche e dalle persone fisiche che agiscono per scopi legati ad una attività commerciale. Restano esclusi dal diritto di recesso anche gli acquisti effettuati da rivenditori o da soggetti che a qualsiasi titolo acquistano per la rivendita a terzi.

In cosa consiste?

Il consumatore ha diritto di recedere dal contratto entro il termine di 14 giorni lavorativi dal ricevimento della merce, restituendo il bene oggetto del recesso al venditore, il quale gli rimborserà la somma versata. A questo punto si puà contattare GDA SAS che Vi informerà della procedura da adottare per aprire la pratica di recesso, dandovi contestualmente l?autorizzazione per la restituzione dei componenti.

La procedura è qui di seguito riassunta:

Invio di una raccomandata con ricevuta di ritorno entro 14 giorni lavorativi a partire dal ricevimento della merce, al seguente indirizzo: GDA SAS via dell?Industria 17/a 60018 Montemarciano (AN) ITALY. La raccomandata dovrà indicare: nominativo del richiedente, codice e descrizione articolo, estremi per effettuare il rimborso. Tale comunicazione potrà essere anticipata anche via Fax, purchè confermata con raccomandata A.r. entro 48 ore.

Come si effettua la spedizione di rientro a GDA SAS?

1. Dopo aver attivato la pratica di recesso è necessario inserire l'involucro originale contenente la merce e lo scontrino ( indispensabile ) in un imballo apposito, in modo tale da salvaguardare gli involucri originali dei prodotti da qualsiasi danneggiamento, scritta o alterazione. GDA SAS si riserva il diritto di rifiutare la merce pervenuta nell?ipotesi di mancato rispetto della procedura sopra indicata.

2. Spedire la merce a proprie spese entro 14 giorni lavorativi, al seguente indirizzo: GDA SAS VIA DELL?INDUSTRIA 17/A 60018 MONTEMARCIANO (AN) ITALY.
