El tema objeto del presente trabajo plantea un gran interes pues la doctrina del margen de apreciacion estatal viene recientemente planteando numerosa problematica al Tribunal de Estrasburgo respecto de su uso en muchos casos de libertad religiosa - v.g. el uso de simbolos religiosos, limites de manifestacion de la religion o ideologia, libertad de reunion y manifestacion, libertad de ensenanza de la religion, patria potestad y educacion religiosa de los hijos, etc. - y por su relacion con el significado de la laicidad del Estado. El problema de la restriccion de derechos fundamentales a traves de la aplicacion de la doctrina del margen de apreciacion del Tribunal de Estrasburgo, plasmada en el articulo 15 del Convenio Europeo de Derechos Humanos, es analizado con el deliberado proposito de impedir su invocacion abusiva por los Estados.
