Unable to use with Surface Pro 4

Put a brand new battery in it and tried to use it with the Surface Pro 4. The setup keeps asking me to press and hold a button the top of the pen, but this does not have one. I tried the buttons on the side but they do nothing.

fell apart

first off the places where your thumbs go would not sit right on the bearing. Then the bearing fell out of the hole and eventually cracked the hole so it would not spin at all.
