Terms and Conditions

When does the Promotion run?

• The Promotion runs from 00:01 (AEDT) on 26th July 2022 to 23:59 (AEDT) on 30th September 2022 (“Promotion Period”).
• eBay reserves the right to cancel or change the Promotion at any time.
• To qualify for the Promotion, items must be sold within the Promotion Period and within 30 days of the buyer clicking on the Shared Link. 

What is the Promotion?

• Eligible Sellers who sell one or more of their items shared through the social sharing link feature will be eligible for a discounted variable fee (2.75% + the fixed order fee of $0.33) for those Eligible Transactions (the “Promotion”). 

• For illustration purposes only: 

  • If the standard variable fee charged for the sale of an item is 11%, and the transaction is an Eligible Transaction, a 2.75% variable fee (inclusive of GST) will be charged instead of 11%. The fixed order fee of $0.33 will still be applied in both cases. 

• Eligible Transactions means any transaction where:

  • The item listing is created by an Eligible Seller on www.ebay.com.au through the ‘Sell Your Item’ form, eBay Seller Tools, or eBay Mobile applications; 

  • The item is shared via a link generated using the social sharing links as set out at: https://cloud.forbusiness.ebay.com.au/social-share (“Shared Link”)

  • The Shared Link is clicked by a buyer; 

  • The same buyer purchases the shared item, or any item from the Eligible Seller’s store, within 30 days of the Shared Link being clicked by the buyer and within the Promotion Period; and

  • The purchased item is paid for in full by the buyer.

• Final Value Fees are the selling fees charged on the sale of an item, calculated as a percentage of the total sale amount paid per item (item price plus postage and handling charges), called a variablefee (formerly referred to as a category percentage fee for store subscribers), plus a fixed order fee of $0.33 (incl GST) per order.  More information about eBay selling fees, with or without an eBay store subscription, can be found here. 

• Eligible Sellers must be logged into their account to use social sharing links.

• The Promotion will automatically apply to all Eligible Sellers and Eligible Transactions during the Promotion Period, in most cases. 

• If the discount does not automatically apply once an Eligible Transaction has been completed, please allow 24 hours for your account to be credited. Any dispute about discounted Final Value Fees must be submitted to eBay in writing within 60 days of the date you incurred such charge, otherwise you waive such dispute and such charge will be final and not subject to challenge.

• eBay reserves the right to cancel or change the Promotion at any time.

Who is eligible for the Promotion?

• Eligible Sellers means Sellers who:

  • Have Australia or New Zealand as their registered address on eBay; and

  • Have either a Basic, Feature or Anchor Store subscription.

• This Promotion is not transferable or exchangeable and is only available to the seller who has access to the social sharing links when logged into their account.

• Members whose eBay accounts are temporarily or indefinitely suspended, made inactive, are subject to listing restrictions, or whose seller performance falls to Below Standard, whether prior to or during the Promotion Period, are not eligible for the Promotion.

What is excluded?

• Items listed in the following categories are excluded from the Promotion: Websites & Businesses for Sale (11759), Aircraft (63676), Boats (26429), Caravans, Motorhomes (32633), Cars (29690), Motorcycles (32073), Trucks, Commercial Vehicles (6049), Real Estate (10542), Services (316), Flights (3253), Tickets (1305), Travel (3252), Gift Cards (172009). These excluded categories are in addition to any listings or categories restricted by eBay's prohibited and restricted items policies. 

• The Promotion does not apply to any other fees other than the variable fee portion of your Final Value Fees.  For the avoidance of doubt, the Promotion does not apply to Store Subscription fees, the fixed order fee, excess listing fees, fees for optional features or services (including Feature Fees), international selling fees and any other fees set out at eBay.com.au, as varied from time to time.

• Listings that contravene eBay's policies or do not otherwise comply with all these Terms and Conditions are excluded from the Promotion.

• For the avoidance of doubt:

  • items that are sold within the Promotion Period but where it has been longer than 30 days since the buyer clicked on the Shared Link; or

  • items that are sold after the Promotion Period ends, even if they are sold within 30 days of the buyer clicking on the Shared Link, are not Eligible Transactions and are excluded from the Promotion.

Miscellaneous

• eBay’s User Agreement and other rules and policies continue to apply and are set out at: http://pages.ebay.com.au/help/policies/overview.html  

• eBay reserves the right to verify eligibility of sellers and listings to receive the promotional credit/discount. Persons who violate the terms of this promotion on eBay.com.au may not be eligible for future promotions on eBay.com.au.

• To the extent permitted by law, eBay is not liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using the promotional credit/discount.

• Any tax liability arising as a result of accepting the promotional credit/discount or in relation to qualifying listings is the responsibility of the seller.

• eBay reserves the right to vary these Terms and Conditions at its reasonable discretion by publishing revised terms on ebay.com.au.

• These Terms and Conditions will be construed in accordance with, and governed exclusively by, the laws of the State of New South Wales.  Each party hereto expressly consents to the exclusive jurisdiction of New South Wales.
